I. WHICH PERSONAL DATA OF JOB CANDIDATES DO WE PROCESS, AND WHY?
1.1. In order to select a suitable candidate for a vacant position, we collect the following personal data of candidates:
- name and surname;
- e-mail address and/or telephone number;
- information about the candidate's work experience (names of employers, period of employment, position, responsibilities and/or achievements);
- information about the candidate's education and qualifications;
- information about language skills and other competences required to perform the functions of the respective position;
- the summary and results of the interview with the candidate, and the feedback and insights of the person who conducted the selection;
- other information voluntarily provided by candidates in their CV, cover letter or other application documents (e.g. recommendations, references). If the candidate chooses to provide such data, it will be processed in the same way as the candidate's personal data requested by the Company.
Special categories of personal data (e.g. information related to a person's health) may be collected only where this is necessary for the selection for a specific position, and only to the extent necessary and permitted under applicable law.
The Company may also collect the candidate's personal data related to qualifications, professional abilities and professional qualities from the candidate's former employer after informing the candidate, and from the current employer only with the candidate's consent.
1.2. For the purpose of administering the candidate database, we collect the following personal data of candidates:
- name and surname;
- place of residence or residential address;
- e-mail address and/or telephone number;
- information about the candidate's work experience (names of employers, period of employment, position, responsibilities and/or achievements);
- information about the candidate's education and qualifications;
- information about language skills and other competences required to perform the functions of the respective position;
- the summary and results of the interview with the candidate, and the feedback and insights of the person who conducted the selection;
- the desired salary, the possible start of employment, the name of the team applied to, and the date(s) of the interview(s);
- other information voluntarily provided by candidates in their CV, cover letter or other application documents (e.g. recommendations, references). If the candidate chooses to provide such data, it will be processed in the same way as the candidate's personal data requested by the Company.
II. ON WHAT BASIS DO WE COLLECT THIS DATA AND FOR HOW LONG DO WE STORE IT?
2.2. In order to select a suitable candidate for a vacant position, we collect data:
- with the candidate's consent, given by submitting the application documents (Article 6(1)(a) of the Regulation)
- on the basis of our legitimate interest in selecting a suitable candidate for a specific position (Article 6(1)(f) of the Regulation)
We store this data for 3 months from the end of the application period.
2.3. For the purpose of administering the candidate database, we collect data:
- with the candidate's consent (Article 6(1)(a) of the Regulation)
The personal data of data subjects included, with their consent, in the Company's candidate database is stored for 3 years from the moment of inclusion (this period is calculated from the moment consent to be included in the database is given, or from the moment the data is submitted if the data is transferred later than the consent is received).
Please note that the candidate has the right to withdraw their consent to the inclusion of their personal data in the Company's candidate database at any time. This can be done by contacting us by e-mail at info@htl.lt.
III. WHERE DO WE OBTAIN CANDIDATES' PERSONAL DATA FROM?
We obtain the personal data of job candidates listed above:
- directly from the candidates themselves, when it is submitted in the form of a CV, cover letter or other application document to our Company's e-mail;
- from the Lithuanian Employment Service, agencies providing recruitment, intermediation or selection services, job search portals, and specialised social networks (e.g. LinkedIn). In all these cases the Company presumes that the candidate has been properly informed about the processing of their personal data and its transfer to the Company, and has given their consent for these actions to the respective entity providing the services listed above.
IV. TO WHOM DO WE DISCLOSE THE PERSONAL DATA OF JOB CANDIDATES?
The personal data of job candidates may be provided to the competent state supervisory and law-enforcement authorities only where this is required under valid legislation applicable to the Company, or in the cases and according to the procedure provided for by legislation, in order to secure or defend the Company's rights, or to bring or defend legal claims.
Access to the personal data of job candidates processed by the Company may also be granted to the following data recipients and data processors: companies providing IT services that maintain and service the Company's e-mail system and servers, and companies providing personnel selection services to the Company.
V. RIGHTS OF JOB CANDIDATES
In accordance with the international and national legislation governing personal data protection, every job candidate whose personal data is processed by the Company has the following rights:
- to submit a request to us to receive confirmation of whether we process data related to the candidate and, if we do, to request access to the processed data and related information;
- to submit a request to us to rectify or, taking into account the purposes of the personal data processing, to complete incomplete personal data;
- to request the deletion of the information we hold about the job candidate if we use it unlawfully, or in other circumstances specified in applicable legislation (e.g. the legal basis for processing has ceased to exist);
- to submit a request to us to restrict the processing of personal data if you contest the accuracy of the data or object to the processing, if you do not agree to the deletion of your unlawfully processed data, or if you need the data to bring, exercise or defend legal claims;
- to object to, or withdraw previously given consent for, the processing of the candidate's personal data where it is processed on the basis of consent;
- to lodge a complaint with the State Data Protection Inspectorate (see www.ada.lt);
- to request the transfer to another data controller of those personal data of candidates that we process in the candidate database.
VI. PROCEDURE FOR HANDLING REQUESTS
Data subjects should submit all requests concerning the exercise of personal data rights in writing:
- by e-mail to info@htl.lt, or
- by post to Liepkalnio g. 200F, Vilnius
Upon receiving a request concerning the exercise of rights, the Company must verify the data subject's identity, and therefore has the right to ask for an identity document to be provided.
Replies to data subjects' requests are provided no later than within 30 calendar days from the date of receipt of such a request and of all related documents required to prepare the reply.
